If you are a US citizen or legal immigrant, chances are that you respect the rule-of-law in America and like generations that came before in this nation, want to see it preserved for future generations. If this is the case, then you understandably have a strong issue with unlawful or illegal immigration and giving undue and unjust rewards for such behavior.

This is a contentious issue because so much is at stake. There are political and cultural consequences as well as economic and national security issues. And, of course, there are practical issues to be concerned with as well. Any reasonable solution to the issue of unlawful immigration will have to do its best to address all these issues as well as adhere to the Constitution.

For now, let’s focus on a couple of key facts regarding this issue and then look at a sensible solution to giving it remedy.

First, factual research shows us that the vast majority of those here unlawfully are not really just a benign class of people who came to America to work and better their lives. Facts prove to us that nearly all of those here working illegally have committed at least two serious crimes—one of which was typically a felony—crimes collectively worth 1 to 5 years in prison and large fines once prosecuted. What is also not well known is that the current unlawful immigration crisis is one of citizen, state, and national security aspects that have officially passed a key legal threshold requiring the federal government to fulfill its legal mandate under Article IV, Section IV of the US Constitution. The law requires the federal government not only to resolve this issue, but to remove all such foreigners on US soil unlawfully from our borders. It is not optional if we are to comply with our Constitution and laws.

Let’s ignore, for our purposes here, all the other imporant aspects of unlawful immigration and simply concentrate on these two noted aspects.

If the rule-of-law counts in America, then it requires those who break our laws to be punished in accordance with the law. This means we have the legal and moral duty to gather up, charge with crimes, prosecute, and jail all those persons on US soil unlawfully who have committed crimes in order to arrive here, secure and use false documents, work illegally, and enrich themselves unlawfully. If we assume there are 12 million unlawful immigrants and two thirds are working illegally and have thus committed two crimes minimum in order to do so, then we are talking about 8 million criminals that have not yet been arrested, tried, convicted, and punished yet.

Equally, we must consider the Constitutional requirement that such foreigners must be removed from US soil in order to comply with Article 4, Section 4. We then have to assume, regardless of their other crimes, that the US is required to deport such unlawful immigrants if we are to comply with our highest law in the land. That means the entire 12 million unlawful population must leave US soil.

However, to be responsible, fair, and humane, we must also assume there are innocent children involved who could be effected by such legal enforcement acts, so steps must be taken to ensure their welfare. Let us not turn the US into a monster for enforcing its own laws. Therefore, we must address these issues in a way that safeguards children–most Americans would agree on this basic principal.

Rather than “round up” and prosecute 8 million unlawful immigrants for their respective crimes, we could save ourselves a lot of time and trouble, yet still provide some level of punishment as required by any sense of moral judgment and decency that respects rule-of-law. And we could comply with our Constitution while also complying with our humane sensibilities to keep families and children safeguarded. The solution is simple, albeit obscure to the media and press (but not to Congress), and is known as BUIRA.

BUIRA, or the Bonn Unlawful Immigration Reform Act, satisfies the Constitution, respect for rule-of-law, moral, ethical, and humane remedies for this issue and situation. And it does it at virtually no cost to US taxpayers–all without a need to “round up” anybody. Moreover, it permanently resolves the illegal immigration issue in America, ending it once and for all.

BUIRA, in effect says, let’s not completely forgive the unlawful immigrant, let us punish them somewhat and comply with our sense of morals, ethics, justice, and American values, but let’s not be overly harsh or inhumane—instead, let us compromise while remaining within the bounds of the law and Constitution and its mandates so we can resolve this issue once and for all and move forward.

The BUIRA solution would put into effect a 1 year amnesty in which all those on US soil unlawfully would be granted immunity from prosecution for their immigration and employment related crimes on a conditional basis. The condition—they would have to voluntarily return home on their own.

During the temporary amnesty period, a moratorium on immigration enforcement would take place so that families could plan their own safe return trips without the need of worry that one member of the family could be deported and thus separated from the family unit. Thus humane treatment is installed into the solution.

To ensure voluntary compliance, BUIRA institutes new laws that make it a felony to trespass a US border the first time as well as overstay a visa or be on US soil unlawfully. And it permanently eliminates any person caught on US soil after the temporary amnesty from being legally admitted to the US or able to immigrate or work in the US or through offshore programs provided by the US—thus removing all incentives to overstay beyond the temporary amnesty period (or to overstay visas or come to the US unlawfully).

Additionally, incentives are created in which all those complying voluntarily with BUIRA are then given the chance to return to the US as legal immigrates through the normal application process rather than be permanetly prohibited (many unlawful immigrants would technically be barred from US citizenship programs due to their multiple illegal entry status, and/or document fraud crimes, etc.). Some who comply early in the program would also be given a chance to win the right to legally stay and immigrate through a one-time immigration lottery, which gives them further incentives to comply (about 50,000 amnesty immigrations would be allowed through the lottery system).

BUIRA also assumes that from 2 to 6 percent of the unlawful immigrant population will not voluntarily comply because such a population is inheriently involved in criminal enterprise and thus ignores the laws anyway. It has provided a solution for this aspect as well, but only enacts it once the temporary amnesty period has concluded and most unlawful immigrants have returned home voluntarily, (which runs for about 12 months).

BUIRA also dramatically reduces the magnet that draws unlawful immigrants to US shores and reduces stress on our borders and visa overstays, thus reducing costs associated with law enforcement.

BUIRA resolves the unlawful immigration crisis sensibly and within the boundaries of current laws, including the Constitution. It only deals with the unlawful immigration aspect and leaves the highly complicated legal immigration and border security issue for another bill and long debate, thus helping clarify the issues and consequences.

The main objective of BUIRA is to resolve the issue of unlawful immigration humanely, yet do so within the bounds of American values, morals, ethics, and respect for rule-of-law. Yes, unlawful immigrants are punished by simply being forced to leave the party and go home. And once the issue of illegal immigration is solved, then the nation can more easily resolve the more complicated issue of legal immigration and its respective issues, such as environmental impacts, national labor force needs, wage depression, etc.

BUIRA is the only solution to date, put forth by anyone, that permanently resolves illegal immigration in America and does so within the bounds of the law and Constitution while so called amnesty schemes do not–and worse, do nothing to stop the issue from reocurring year after decade.

First, allow me to educate the radical left that supports law breaking (unlawful immigration) and the harms it causes by simply letting them know that several dozen of my friends and acquaintances are actually citizens of Mexico, few of which condone their own countrymen coming to America unlawfully—fewer still who would ever condone the reverse (that is, millions of foreigners coming to Mexico unlawfully and exerting their political influence and harms against both the citizens, government, and Mexican Constitution).

I, like most Americans, support lawful immigration—not the harmful, criminal alternative (now well documented). Now having said that, allow me to ask…

Could unlawful immigration be ended in under a year without an amnesty and without meaningful argument from illegal aliens, far left radicals, or government?

The answer is—YES!

Okay, enough with the suspense—what’s this all about?

The answer is either state/s or citizens must simply petition the federal government for relief under Article 4, Section 4, of the U.S. Constitution. For those of you who do not know your Constitution, here is the appropriate law section quote:

The United States shall guarantee to every State in this Union a Republican form of Government, and shall protect each of them against Invasion . . .

United States is defined as the federal government and Invasion can be defined as:

Any foreign group of substantial mass, organized or not, who inflict collective harms on the well being of any state or its respective citizens.

In 1776, such a foreign invasion group of just 10,000 persons would have been considered adequate to meet such legal terms—today, there is a growing invasion force of over 10 million foreigners (at least 5 million from Mexico alone) assailing US soil, government, and citizenry, challenging the validity of the US Constitution, the Rights of States, and the Rights of US citizens.

Many in the leftwing media downplay this issue as merely immigration—people who want to come and work in America—never acknowledging or perhaps realizing the multitude of great harms unlawful immigrants have on the citizenry, their states, and the national government and its security—or worse, know and do not care.

Should the federal government refuse to act and abate this foreign invasion, then an entire series of legal ramifications and remedies befall the situation (basically, they are all very bad for the federal government and good for states and their citizens).

For example, states would then have the legal right to unilaterally invoke various remedies on their own, such as:
1. Amass an army (police force) to abate the invasion.
2. Deduct federal tax proceeds (e.g. hijacking federal taxes) to pay for remedies.
3. File for secession and eject all federal government from the state.
4. Cut off all federal tax-forwarding and channel such funds to repay the state and its citizens for any and all damages caused by the invasion since the invasion began.
5. And much more…

In some cases, states could simply play a high stakes game of “secession negotiations” to force the hand of the federal government to abate unlawful immigration and pay out all monies due for all past harms it has caused (highly impacted states like California could be entitled to as much as $200 billion dollars or more by documenting harms back to the end of the 1986 unlawful amnesty).

This is a very powerful law as it is part of the Constitution itself. It has also been the focus of lots of censorship by the White House, some state governments, Congress, and left-leaning news media who have collectively worked to suppress it from being exposed—especially to grassroot groups, such as the Tea Partiers.

Yet it is this very law that makes an “amnesty” technically unconstitutional—for an amnesty would actually condone and reward, rather than abate, an Invasion. Other aspects of law could also make such an amnesty technically a treasonous affair. For example, if just one person among those amnestied were proven to be a declared enemy of the United States, such as a hidden member of Al Qaeda—then each and every person in Congress (who voted for it) and the President would be subject to treason charges—very scary stuff none of us wants to ever consider but hard reality, all the same.

The reality is, if just one state or major citizen group invokes Article IV, Section IV toward relief, then likely every state in the union that has been hit by the harms of unlawful immigration and its costs, will likely jump on the bandwagon to claim their fair share of federal reparations. The federal government could be forced to repay states and their citizens trillions of dollars in past harms—ouch—not to mention still be forced to abate the invasion and send all unlawful immigrants packing.

Taking Grassroots Action
The time to act is now, while the economy remains very bad and Americans need employment opportunities—good US citizens and lawful immigrant families are suffering this very minute, needing the millions of high paying jobs that many unlawful immigrants are taking by criminal actions. With enough public pressure, Congress and the White House will buckle on their position toward amnesty and will uphold the Constitution—but only if significant public pressure from the streets forces their hand.

Here is one simple recipe for grassroots success—just one person could get the ball rolling and make a difference:

1. Form a small grass roots group consisting of two attorneys (both specializing in Constitutional law), one webmaster tech with excellent SEO skills, two phone jockeys, one public relations manager, and a handful of email and blog enthusiast who can spread the word virally and recruit to build up a larger grass roots group (or recruit other groups to the cause as a coalition effort).
2. Recruit one or more national personalities to help with the cause and draw in the national media and keep them involved.
3. Forward the signing of the petition (invoking Article IV, Section IV protections/ relief) until 1 million US citizen signatures are collected (Internet petitions are not legally acceptable—you must use the old fashion hand, pen, and paper petition system if you’re serious about winning).
4. Create a marching day and bring together the masses to march in protest on Capitol Hill (or any given State Capitol Hill) and make your demands known.
5. Sustain the effort until victory is achieved while your attorney keeps up with the paperwork and legal maneuvers, constantly pushing the case toward the US Supreme Court and getting in front of the national news media.
6. Recruit as many non-leftist journalist as you can find to help (sorry, that’s only 1 out 8 in today’s America, sad to say, so expect lots of nos to get to the yeses who can help get your story out).

We can all take out our hatchets and go to work on each other or we can apply common sense, humanity, and reason to the problem of illegal immigration.

First, lets all agree that breaking the law is wrong. Next, lets all agree that dozens of federal laws prohibit unauthorized entry or stay on US soil and that these laws are required to ensure civility, national security, and orderly and regulated immigration. And let’s all agree that Congress’s incompetency has caused the current illegal immigration problem by allowing it to fester and grow even after its 1986 amnesty promise to ensure otherwise—it is no surprise the institution is deceitful and incompetent. Lastly, due largely to Congress’s anti-American stance on immigration and border security that has markedly eroded our national security to the point of foolishness, we have a sad issue to contend with—rooted illegal alien families and lives in America.

The argument is made clearly that parents who break the law thereby doom their children to the recourses of law enforcement. Hundreds of thousands of people commmit crimes yearly and force the break-up of their own familes. Such is the consequences of criminal behavior.

Yet many jouranlist want to make the false arguement that illlegal immigration is not a crime and that parents have no responsbility to the law or their families. This is the anarchist’s view, not the view of a law abiding and orderly society.

Millions of criminal immigrants have been flagrant with their children’s lives and well being, this cannot be argued—the parents could have built a better life for the children legally, but instead, did so criminally. Mainstream propagandists, aka journalist, would have us believe society owes liency to such crminals for the sake of children, but the arguement then would apply to all criminals—the bank robber who just wanted a better life for his family—no?

A quandary arises in law that is very clear, the illegal immigrant is a criminal and hence required to repatriate, yet that leaves the question of their children—many of whom have obtained US citizenship through the illegal act and misinterpretation of the 14th Amendment by many irresponsible US hospitals—a tragic fact we cannot change.

To cut to the chase… What we are left with now are two questions. How do we clean up the current mess and restore lawful immigration and border / visa integrity? And how do we keep this from happening again?

Here is the simple yet compromise and humane solution, which requires a lengthy bill to set in remedy—it satisfies all arguements while upholding the law and being human to families.

1) Offer a 6 month period for all illegal immigrants to come forward and be issued a Temporary Exemption I.D. Card and work permit that is good for 12 months (no extensions). The card will keep them from being arrested for immigration related laws and being forceably repatriated. It will also bring them out of the shaddows.

2) Give parents the right and easy means to renounce their child’s US citizenship, should they so chose, in the event the parent wishes to return home with their child and not be separated.

3) On a set date, have all new immigration laws and stringent enforcement begin (about 4 months after all Temporary Exemption I.D. Card have expired).

4) Anyone caught in the US illegally after that deadline is then processed as a felony US soil trespasser under national security laws and treated as a dangerous criminal. They are no longer considered a mere illegal immigrant and no liency is given.

5) Anyone who illegally immigrants and recieves their 12 month Temporary Exemption I.D. Card, and who applies for aid for themselves and/or their family, is then given all the family friendly assistance they need to repatriate, including free housing, transportation, food, and a stipend to live on once repatriated. The government can use temporary processing centers to aid the repatriation process.

6) Anyone who voluntarily repatriates gets additional benefits, including: qualifying status that would allow them to apply for legal immigration (through normal protocols–not given special priority of any kind, but not blocked either, as are non-volunteers), forgiveness for immigration related crimes (non-violent), and entry into a citizenship lottery with 10,000 give-always. Winners can include their immediate family when legally immigrating.

7) The government can, on a case by case situation, allow for exemptions from the program to qualifying families: Families who have valid proof of 5 years of home ownership paid taxes, and verifiable proof of seven years of US residency, and have no criminal record either in the US or any other country. Although this provision allows some illegal immigrants to slip through the system, it is a compromise provision that allows the entire clean-up effort to work while limiting the number of exemptions to keep taxpayer harms mitigated. A limit of 500,000 exhemptions would be set and would only apply to families with US citizen.

8 ) Secure the borders with 99% integrity (meaning the US government captures 99% of those trying to enter illegally instead of the now 20%). This will aid in the fight of drug trafficking, border security, and terrorism security as well. Border Sheriff’s report the job can be done within 90 days if they are given funding to allow them to ramp up.

9) Anyone who enters the US illegally or overstays a visa, etc. or who remains on US soil after the “exhemption period” expires and once the new laws install will then be committing a national security felony and by law, treated as a potential terrorist until repatriated (after their prison term is completed); such persons are permanetly barred from US citizenship or entry (for life). Anyone hiring such a person shall be culpable–the person in charge of the hiring is subject to $100,000 fine and 1 year minimum jail sentence, in addition to company fines.

10) Reinstall and permanetly fund e-Verify for the free use by all employers. Require all employers, including all local, state, and federal governments, to pass all new hires through an eVerify check prior to starting work. Require all current employees be screened as well over the next 16 months.

This approach achieves several things:
• It cleans up the illegal immigration problem while still recognizing and supporting the law, yet being very humane to families. It gives everyone a full year to satisfy their current situation and plan for repatriation under a family friendly system.

• It prevents illegal immigration from happening on a wide scale again.

• It saves taxpayers trillions of dollars in costs to cover a full and unconstitutional amnesty over the lifetime cycle of those amnestied.

• It gives illegal immigrants who have not otherwise committed crimes a strong incentive to cooperate: a) gives them a clean slate and legal ability to return to the US as lawful immigrants some day, if the so chose, b) does not prosecute them for their immigration related crimes (non-violent), c) helps them with the costs of repatriating and resettlement, as well as provides a legal, safe, and secure means to humanely keep the family together, d) sets up a harsh penality system for not voluntarily cooperating.

• It clearly divides the more violent criminal class of immigrants from the more benign class who will freely and openly cooperate, paving the way for law enforcement to handle the criminal elements with more aggressiveness without public outcry.

• It restores our lawful immigration process, maintains the dignity of those who have lawfully immigrated, and restores faith in government for upholding the law yet using a more humane, family oriented approach that respects the dignity of all those who comply.

• It achieves the end results required by the law and the majoiry of Americans while avoiding Draconian alternatives or unconstitutional and cost prohibitive amnesty—a true win/win for society, taxpayers, illegal immigrants, legal immigrants, and lawmaker/politicians.

Diffusing A Flash-Point Issue
Much of the heat that comes from Americans on this issue is due to the fact that Americans traditionally want strong law enforcement and want to see crime deterred by it.

Over 14 million Americans are out of work and many need the jobs that illegal immigrants are taking illegally. An estimated 75% of Americans claim they want strong immigration enforcement and that number is growing as the economy worsens—an estimated 2-5 million decent to high paying jobs taken now by illegal immigrants would be freed up for US citizens whose families need jobs. Despartism is growing and this issue is reaching stronger potential each day toward being triggered into violence—a flashpoint that Congress itself could spark.

An amnesty shreds all idealism and rewards criminal behavior, hence this issue will remain a flashpoint issue on both sides until settled—amnesty could actually force mass rioting by Americans and a flood of hate crimes against illegal immigrants—many Americans despise those who stand on the pro law-breaking side of this issue.

Racism Charges Are Unfounded And Unworthy Of Legitimate Consideration
This issue is often touted deceitfully as an issue of race, however, it is clearly not. It is a simple issue of law and respect for it—our laws serve a valid purpose and those who seek to skirt the law or hide behind the false claims of racism will always be viewed dimly. We know that illegal immigrants come in all flavors—White, Black, Asians, Hispanics, you name it. If racism is the issue, then precisely which race is being singled out on a mass scale and where is the proof of such an absurd allegation? There is no proof, merely lies and deciet and much of it swallowed by or spit out by an ignorant and lazy press corps that refuses to do fact finding.

The sad fact is, there are millions upon millions of foreigners on US soil illegally, none of which our government can identify–many of which we have no clue of their intentions—many of which are White, or Black, or Asian, etc… maybe even some green Martians, too–who knows–who cares–people are people and criminals are criminals, regardless of color, ethnicity, or race!

Illegal Immigration Is A National Security Issue
At last check, ICE reported that over 78,000 illegal immigrants were on US soil from countries that sponsor terrorism—yet ICE has no idea where these people are or who they are. And at the current capture rate of suspected and actual terrorists, it will take 557 years for the FBI to find these people. By cleaning up the illegal immigration nightmare with such a simple, humane, and cost effective compromise proposal, we can shorten that timeframe to about 3 years and make America much safer.

Safe America Act Bill Proposal (Ends Illegal Immigration Permanently)
The Bonn Safe America Act is now in mothballs but with only minor editing, could become law this year if Congress took a pro-American, pro-law, pro-humanity approach and applied reason and solution making rather than divisive politics.

The majority of the illegal immigration issue could quickly be resolved within about 24 months under this plan. Criminal aliens will require a little longer mop up period to abate, but with the more benign classes of illegal immigrants removed, law enforcement will be less clogged and more able to effectively administer such a nasty group.

Program Has No Net Cost To Taxpayers – Saves Over $1 Trillion!The Bonn Safe America Act would place about $1 trillion into taxpayer cofferes over 5 years (the program needs no new funding to achieve the program—see the Safe America Act for how the program is managed and funded so as not to cost taxpayers a dime. The issue of illegal immigration would never return in our lifetime if this system is applied.

Summary Take-Away
The key take away from all this is that there is an alternative to attrition, an alternaitve to amnesty, and an alternative to being inhumane, as well as an alternative to be Draconian or in letting this problem be the cause of the next major terrorist attack on the United States. This proposal could save untold millions of lives if Congress will act. Nobody wins on the issue, but the issue is resolved once and for all and is supported by both the law and Constitution–few other proposed remedies meet that reality—especially amnesty.
